In compliance with the Federal Law on Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares) (hereinafter referred to as the “Law“) and in order to establish and delimit the scope, terms and conditions applicable to the data treatment, we provide you with this Privacy Policy, which is intended to inform you about the treatment that will be given to your personal data when they are collected, used, stored and/or transferred by Wilson Abogados, S. C. (hereinafter referred to as “Wilson Abogados” or the “Responsible“), by our clients, suppliers and third parties (hereinafter referred to as the “Owner” or “Owners“).

Identity and address of the responsible party

Wilson Abogados with address at 2914 La Rioja Street No. 2914 Office Number 6-A, in Colomos Providencia neighborhood, C.P. 44630, in Guadalajara, Jalisco, with authorized email: contacto@wilsonabogados.com. We are identified as the Responsible for the processing of data provided by the Owners whether directly or indirectly collected personally or in any other form of communication established by the Law.

Data protection principles

The personal data provided by the Owners to Wilson Abogados will be processed solely for administrative, legal and informational purposes directly related to strategic planning, client development and legal advice, respecting at all times the data protection principles of consent, information, quality, purpose, loyalty, proportionality and responsibility in the processing of such data in accordance with the provisions of Article 6 of the Law.

The sending of personal data is necessary for the main purposes set out in this Notice, therefore, not providing the requested data or not accepting this privacy policy means the impossibility to be recognized as a client, supplier or third party related to Wilson Abogados.

List of personal data to be requested

The Owner agrees to provide Wilson Abogados with the following categories of data for the purposes set forth in this privacy notice:

Personal Data:

  1. Contact data understood as the information that allows to maintain or get in contact with the Owner, such as: address, email, cell phone, and social networks.
  2. In the case of suppliers, the type of services they provide, company name, bank accounts, tax information, payment methods, contact information, and all the necessary information to provide us with the corresponding service in the appropriate manner.
  3. We receive and store all information that you enter on our website https://wilsonabogados.com/ or provide to us by any other means.

When necessary, and for the development of projects with clients, we will request the following data:

  1. Identification data understood as that information that allows individualizing the person such as full name, marital status, place and date of birth, nationality, age, as well as the data (number and codes) derived from their official identification credentials such as: the voting credential issued by the National Electoral Institute (Instituto Nacional Electoral), the registration card before the Federal Taxpayers Registry (Registro Federal de Contribuyentes) or the Unique Population Registry Code (Clave Unica de Registro de Población).
  2. Bank or asset data, such as bank account number and tax information.

Data processing purposes

The Owner accepts that his/her personal data will be used by Wilson Abogados for the following purposes, which are classified into main purposes and secondary purposes:

  3. Carrying out official procedures that are needed, for any legal process, trial, report and/or legal work.
  4. To provide legal services with the agreed quality.
  5. Secondary Purposes:

  7. Receive information on related legal, financial and/or accounting institutions.
  8. Receive invitations to events and activities external to Wilson Abogados.

If the Owner agrees with the treatment of his/her personal data for the main purposes set forth in this notice but does not want them to be treated for the secondary purposes set forth herein, he/she may communicate this immediately by sending an e-mail to contacto@wilsonabogados.com addressed to the area of Protection of Personal Data (hereinafter referred to as the “Data Protection Officer“).

Data transfer to third parties

The Owner accepts that their data will be transferred by the Responsible, to all those companies and government offices to comply and carry out the procedures that are necessary to provide legal services with the quality granted.

Therefore, Wilson Abogados is bound to communicate to such third parties this Privacy Policy and the obligations they assume regarding the processing and protection of the personal data of the Owners upon receipt of such information.

All data are treated with absolute confidentiality and will not be accessible to third parties without an agreement with the Responsible, and it is forbidden to use them for any other purpose than the ones authorized.

Resources to exercise rights of access, rectification, cancellation and opposition (ARCO rights)

Any Owner who provides their data to Wilson Abogados by any form may exercise their rights of access, rectification, opposition and cancellation by sending an email with a clear and precise description of the personal data to which they seek to exercise any of the aforementioned rights to the email contacto@wilsonabogados.com; the foregoing in accordance with the provisions of Article 28 of the Law.

The responsible for knowing and exercising such rights is the Area of Protection of Personal Data of the Responsible in accordance with the provisions of paragraph 3, section IX of the Law.

It is located at la Rioja Street No. 2914 Office 6-A, Colomos Providencia neighborhood, C.P. 44630, in Guadalajara, Jalisco, and the Owner may communicate with the Data Protection Officer by calling (33) 2737 2724 or through the authorized e-mail: contacto@wilsonabogados.com.

The Owner shall complete and deliver to the Data Processor Officer indicated above, his/her request accompanied by the following documentation, in accordance with article 29 of the Law.

  1. Current official identification of the Owner (credential issued by Instituto Nacional Electoral, passport issued by the Secretaría de Relaciones Exteriores, National Military ID or Professional ID). In case of foreigners: immigration form or passport from their country of origin.
  2. In cases in which the exercise of ARCO rights is carried out through the legal representative of the Owner, in addition to the accreditation of the identity of both, the corresponding power of attorney signed before two witnesses and a statement to the Data Processor Officer will be required.
  3. In cases where you wish to exercise the right of rectification, you will have to provide the documentation supporting the requested change, according to the personal data to be modified.
  4. In case of cancellation and/or opposition, please provide documentation describing the personal information that you are interested in removing from the records of the Responsible and/or the personal information that you wish to terminate the treatment, as well as the damage that would be caused if the treatment of the personal data continues.

Responses to your request will be carried out by the Responsible within a maximum period of 20 working days, counted from the date on which the request was received. The Responsible may extend the term for up to 20 (twenty) more business days, if so required, prior notification of this situation to the Owner.

The Owner may request access, rectification, cancellation, and opposition of their data for its use in accordance with the secondary purposes listed above, within 2 months from the date of registration. After this period, and without any request for change, it will be understood as accepted the conditions set forth in this policy.

The resolutions adopted by the Responsible will be communicated through the options chosen for it, which are found in the respective formats, the foregoing in accordance with the provisions of articles 32 and 33 of the Law.

When the Owner requests the delivery of his personal data, it will be free of charge, and the Owner will only have to cover the justified shipping costs or the cost of reproduction in copies and other formats. However, if the Owner reiterates his request in a period of less than twelve months, the costs will not exceed three days of the current minimum wage, unless there are substantial modifications to the privacy policy that justify the new consultations.

Security of the information

The Responsible has adopted the administrative, physical, and technical security levels for the protection of personal data, and may additionally implement other technical measures within its scope to prevent the loss, misuse, alteration, unauthorized access or reproduction and theft of personal data provided by the Owner

Information technology

Cookies are text files that are automatically downloaded and stored on the hard drive of the Owner’s computer equipment when browsing a specific Internet page, which allow the Internet server to remember some data about the Owner, including your preferences for viewing the pages on that server, name and password.

Web beacons are images inserted in a web page or e-mail that can be used to monitor the behavior of a visitor, as well as to store information about the IP address of the Owner, the time of interaction on that page and the type of browser used, among others.

Conditions of acceptance and use 

When the personal data are delivered personally and directly by the Data Subject, the Data Controller will make this policy available to them in a visible place so that they can express their acceptance prior to the collection of the data.

In all other cases, this privacy policy is made available to the Owner on the page https://wilsonabogados.com/ and is understood to be accepted if the Owner click in “SEND OR ACCEPT” button found on the data collection forms or if by any other means they provide their data without expressing opposition to the purposes and conditions set forth herein.

The Owner, as a user of the services and this website, authorizes the Responsible for the automated processing of personal data provided through forms and / or email, to be used for informational purposes and related to the daily administrative operation of the Responsible, as well as to provide legal services with the agreed quality.

The Owner who sends the information to the Responsible, is the only one committed to the veracity and correctness of the data included, relieving the Responsible of any responsibility in this regard. The Owners guarantee and are responsible, in any case, for the accuracy, validity and authenticity of the personal data provided, and undertake to keep them duly updated.

If the Owner wants to revoke the consent granted to the Responsible in this Privacy Policy, they may do so by sending their revocation request to the e-mail address contacto@wilsonabogados.com.

Through the website, the Responsible makes available to the Owners through the Internet, by means of direct display or by means of links, access to various content, information, and services. Access to this website implies acceptance by the Owner of the conditions of use contained herein and undertakes to use the contents in a legal and lawful manner, in accordance with morality without infringing the rights of the Responsible or third parties.

The use that the Owner makes of the materials contained herein is the sole responsibility of the Owner, and the Responsible Party will not be considered responsible for the incorrect or illegal use of such materials by the Owner.

Procedure by which changes to the privacy policy will be communicated

The Responsible reserves the right to modify this Privacy Policy to adapt it to new legislation or jurisprudence of Mexico.

Any modification can be consulted on the website https://wilsonabogados.com/ and we invite you to visit it so that you can be and remain informed. This provision does not entitle the Owners to any right to receive compensation for damages.

Applicable Law and Jurisdiction

For all matters relating to the interpretation and enforcement of this Privacy Policy, as well as for all those not expressly stipulated herein, the Owner submits to the jurisdiction of the courts of the City of Guadalajara, Jalisco, so the Parties waive the jurisdiction that may correspond to them by reason of their present or future domicile or for any other reason.
